When I initially searched the U.S. Patent and Trademark Office database and Google Patents, I missed something very interesting in the war [1][2] between Apple, Inc. (AAPL) and Android's "Big Three" -- Google Inc.'s (GOOG) new acquisition Motorola, HTC Corp. (TPE:2498), and Samsung Electronics Comp., Ltd. (KS:005930) -- regarding swipe-to-unlock intellectual property.

Neonode Inc. (NEON) appears to be the first to patent this technology, holding a claim I missed.

I. Neonode Beat Apple to the Patent Punch by 3 Years

As I pointed out in an earlier piece, Neonode -- a small Swedish phone manufacturer -- was the first to deploy the technology commercially. And it also appears to be the first to have patented swipe-to-unlock.

I initially missed this, as it was buried in U.S. Patent No. 8,095,879.

But there it is -- in "User interface for mobile handheld computer unit." Fig. 11 and Fig. 12 (pg. 5).



And the interface element is covered by Claim 12:

12. The computer readable medium of claim 1, wherein the user interface is characterised in, that an active application, function, service or setting is advanced one step by gliding the object along the touch sensitive area from left to right, and that the active application, function, service or setting is closed or backed one step by gliding the object along the touch sensitive area from right to left.

The captured image is then transmitted to a host system.

This blog post by Scott Daniels, an experienced patent litigator and author of the leading blog on U.S. patent reexaminations (WHDA Reexamination Alert), lists high-profile reexamination requests filed last week, including two anonymous ex parte requests against Apple's two most important multitouch software patents: U.S. Patent No. 7,469,381 (the overscroll bounce, or "rubber-banding", patent) and U.S. Patent No. 7,479,949, the touchscreen heuristics patent (first on the list of inventors: Steve Jobs). Those are by far and away Apple's most important multitouch software patents. In terms of breadth, patents like the photo gallery page-flipping patent or even the slide-to-unlock patent pale in comparison.

HTC is claiming victory in a patent dispute with Apple after a ruling by the High Court in London.

The judge ruled that HTC had not infringed four technologies that Apple had claimed as its own.

He said Apple's slide-to-unlock feature was an "obvious" development in the light of a similar function on an earlier Swedish handset.

Apple has also cited the patent in disputes against firms using Google's Android system software.

Slide-to-unlock
HTC launched the London-based lawsuits a year ago as part of an effort to invalidate European patents Apple had referred to in a German court case. Apple subsequently countersued.

The four patents at stake were:

  • Unlocking a device by performing a gesture on an image.
  • The use of a multilingual keyboard offering different alphabets on portable devices, including mobile phones.
  • A system to determine which elements of a screen were activated by single-finger touches; which were activated multi-finger touches and which ignored touches altogether.
  • Letting a user drag an image beyond its limits and then showing it bounce back into place to illustrate that they had reached its furthest edge.

Apple had claimed HTC's Arc unlock mechanism infringed its technology
The judge ruled that the first three patents were invalid in this case, while the fourth did not apply to HTC's devices.

Lawyers fighting other lawsuits against Apple are likely to pay close attention to the decision regarding its slide-to-unlock patent.

The judge said that HTC's "arc unlock" feature - which also involves a predefined gesture along a path shown on-screen - would have infringed Apple's technology had it not been for a device released in 2004.

The Neonode N1 showed a padlock on its screen with the words "right sweep to unlock" when it was in its protected mode. A later version replaced the text with an arrow.

The judge said it would have been an "obvious" improvement for the developers to have offered users visual feedback in the form of a "slider" in the way that Apple later used.

He added that the concept of a "slider" was not new since it had already appeared in Microsoft's CE system.

As a result Apple's claim to the innovation was rejected.

Apple Inc. (AAPL) was ordered by a judge to publish a notice on its U.K. website and in British newspapers alerting people to a ruling that Samsung Electronics Co. didn’t copy designs for the iPad.
The notice should outline the July 9 London court decision that Samsung’s Galaxy tablets don’t infringe Apple’s registered designs, Judge Colin Birss said today. It should be posted on Apple’s U.K. home page for six months and published in several newspapers and magazines to correct any impression the South Korea-based company was copying Apple’s product, Birss said.
The order means Apple will have to publish “an advertisement” for Samsung, Richard Hacon, a lawyer for Cupertino, California-based Apple, told the court. “No company likes to refer to a rival on its website.”
Apple is fighting patent lawsuits around the globe against competitors including Google Inc., HTC Corp. (2498) and Samsung as it competes for dominance of the smartphone and tablet computer markets. The firms have accused each other of copying designs and technology in their mobile devices. Legal battles about the similarity of Samsung and Apple tablets are being fought in Germany, the Netherlands and the U.S.
Public Statements
Birss said in his July 9 ruling that Samsung’s tablets were unlikely to be confused with the iPad because they are “not as cool.” He declined today to grant Samsung’s bid for an injunction blocking Apple from making public statements that the Galaxy infringed its design rights.
“They are entitled to their opinion,” he said.
Apple spokesman Alan Hely didn’t immediately respond to a phone call and e-mail requesting comment on the judge’s order.
“Should Apple continue to make excessive legal claims based on such generic designs, innovation in the industry could be harmed and consumer choice unduly limited,” Samsung said in a statement after the hearing.
“The war between these two companies seems to be escalating even further,” said Colin Fowler, an intellectual property lawyer at London-based Rouse. He said much of the publicity around the July 9 ruling focused on Birss’ comments about Samsung not being as cool.
“From a victory in court they were suddenly on the back foot,” Fowler said in a phone interview. “Getting this order fits in with the context of them trying to restore the balance.”
‘Commercial Harm’
Comments made by Apple after that ruling unfairly implied that Samsung had copied designs, Samsung’s lawyer Kathryn Pickard said at the hearing. That “caused real commercial harm.”
As well as Apple’s website, the company must pay for notices in the Financial Times, the Daily Mail, Guardian Mobile magazine, and T3, according to a draft copy of the order provided by Samsung’s lawyers.
Apple’s lawyer said the company would appeal the July 9 decision and Judge Birss granted the company permission to take its case to the court of appeal.
The case is Samsung Electronics (UK) Limited & Anr v. Apple Inc., High Court of Justice, Chancery Division, HC11C03050.

Έχουν διαρρεύσει αρκετά έγγραφα που δείχνουν τα σχέδια των πρωτότυπων του iphone, σε ένα από αυτά υπάρχει το λογότυπο της Sony και σε ένα άλλο το λογότυπο Jony :137:.

Πολλά ενδιαφέροντα γεγονότα διαδραματίζονται κατά την διάρκεια της δίκης.
Το νομικό σύστημα στις Η.Π.Α. είναι λίγο περίεργο σε σχέση με το δικό μας, ο δικαστής λοιπόν αποφάσισε να εξαιρέσει από την διαδικασία μερικά έγγραφα που παρουσίασε η Samsung, γι' αυτό τον λόγο η Samsung αποφάσισε να τα διαρρεύσει, τα είδε η Apple να κυκλοφορούν στο διαδίκτυο και θύμωσε.

Πάρτε το smartcover keyboard των Windows Surface, προσθέστε λίγο sideshow, βάλτε λίγο από Fujitsu lifebook concept και συνδυάστε τα σε μια flexible AMOLED, αυτή είναι η νέα πατέντα της Apple...... :137:
πάντα μπροστά αυτή η εταιρία, ποτέ δεν κλέβει ιδέες άλλων....:614:
Δεν ξέρω πως την κατοχύρωσε τελικά ή πόσο θα αντέξει
